INVITATION TO BID:
SLUDGE DISPOSAL
The Town of Lewisboro is seeking sealed bids for pumping, hauling and properly disposing of liquid sludge from the Town of Lewisboro’s two Sewage Treatment Plants, Wild Oaks Sewer and Oakridge Sewer. Sealed bids will be accepted at the office of the Town Clerk, P. O. Box 500, 11 Main Street, South Salem, New York until 11:00 a.m. on March 24, 2008.
All bids for pumping, hauling, and properly disposing liquid sludge from the Town of Lewisboro’s two Sewage Treatment Plants (Wild Oaks Sewer and Oakridge Sewer) must conform to the following:
- Oakridge Sewer sludge amount is approximately 150,000 to 300,000 gallons per year. Wild Oaks Sewer sludge is approximately 100,000 to 200,000 gallons per year. Minimum sludge pickup amount per day of requested pick up is: 6,500 gallons for Wild Oaks; 13,000 gallons for Oakridge
- Sludge will be properly disposed of in accordance with all Westchester County, New York State, and Federal Requirements.
- The Contractor must have in existence an executed agreement with a licensed facility for the disposal of sludge. Said contract shall provide adequate disposal capacity for the term of this proposed contract.
- The contractor must be available within forty-eight (48) hours of notice to remove sludge.
- The contractor agrees to be responsible for all spills within and outside of the Town properties during loading, unloading and transportation of the sludge.
- The contractor is responsible for obtaining and maintaining all required permits. Copies of such permits must be received by the Town of Lewisboro with all bids.
- The contractor is responsible for all laboratory testing required to obtain all required permits.
- Sludge hauled will be approximately 1% - 5% solids.
- All equipment for loading and unloading of sludge will be the responsibility of the contractor. The Town of Lewisboro will not be responsible for any item relative to loading and unloading.
- The contractor is responsible for compliance with all applicable safety standards.
- The contractor is responsible for the difference between the original bid and the actual amount expended by the Town of Lewisboro if another contractor must be hired due to lack of performance by the contractor.
- The Town of Lewisboro or their representative reserves the right to inspect the equipment, and/or documents of the contractor at all times if a safety violation is believed to exist.
- The Town of Lewisboro shall be a named insured on all policies of insurance, which shall be in effect
throughout the period of the contract. All certificates of insurance shall be filed with the Town Clerk
and shall be subject to the Town’s approval for adequacy of protection. Said certificate shall contain a
thirty-day notice of cancellation in favor of the Town of Lewisboro.
- The contractor must be bonded.
- The contract shall commence as of the date of approval by the Town Board and execution by the Town Supervisor.
- The term of the contract shall be for one (1) year from the date of execution by the Town Supervisor

Sealed bids will be received by the Town Board of the Town of Lewisboro, for the following contract:
Lake Kitchawan Stormwater Treatment Project
STORMWATER FILTERING UNIT
The Work consists of generally detailed Design, Manufacturing, Delivery and assembly of all internal parts of a fine particle-filtering unit with the goal of removing fine particles in the range of 10 microns to 50 microns and phosphorous from the storm water flow. The filtering system shall be designed in a subsurface concrete vault with a minimum dimension of 8’ x 11’. Filtration shall occur within multiple filter cartridges such that at the design-loading rate specified, the total suspended solids concentration of the treated stormwater is at least 80 percent lower than the concentration of the untreated influent entering the filters based on laboratory testing. The proposed filtering unit shall be installed after an existing Vortechs Model 9000 stormwater treatment system. The Town of Lewisboro shall provide the site design, permitting and obtain the local permits. All site work including excavation, setting filtering vault unit, backfilling, connecting external pipes, etc (but not including work inside of the vault) shall be bid as a separate contract.
Sealed bids will be received at the Office of the Town Clerk until May 15, 2008 at 2:00 PM, at which time and place they will be publicly opened and read aloud. Bids shall be contained in a separately sealed, opaque envelope clearly marked “Bid for Lake Kitchawan Stormwater Treatment Project- Stormwater Filtering Unit”. Sealed Bids shall include Bid Form, Bid Guarantee Check (5%), Non-Collusive Bidding Certificate, detailed specifications and design of proposed filter system, etc. Faxes, emails and incomplete bid packages will not be accepted.
The Contract Documents including: “Project Specifications and Bid Document” and Plans for the proposed work shall be on file at the office of the Town Clerk on May1, 2008 at 12:00PM. The Contractors/Prospective Bidders shall leave their names, correct mailing addresses, telephone number, and fax number upon receipt of a set of Contract Documents. The office hours of the Town Clerk’s Office are Monday through Friday, 9:00 a.m. to 4:30 p.m.
The successful bidder shall enter into a contract for the same, within (7) days after notification of award of contract. If no contract is awarded within 60 days of the opening of bids, the bid may be withdrawn.
The successful bidder shall be prepared to commence work within 7-days of contract signing and submit complete Shop Drawing within 14 days of contract signing.
All bids shall be submitted subject to the following conditions:
- The Town Board of the Town of Lewisboro (“Town”) reserves the right to reject any or all bids and re-advertise for new bids for any reason.
- All bidders shall submit proof of responsibility and qualifications, as required by the Contract Documents. The Town shall determine if the qualifications are adequate. If the qualifications of the lower bidder are not adequate as determined by the Town, the bid may be awarded to the next lowest bidder.
- Each bid must contain the certificate of non-collusive bidding.
- No bids shall be withdrawn for a period of sixty (60) days after the receipt thereof, without the consent of the Town.
- The bidder shall make allowance in his bid for any price increase in labor and materials. Requisitions for work and/or material shall be at the price bid with no additional charges for such increases.
- The Contractor shall be paid on a Unit Price basis, and the Town reserves the right to eliminate portions of the project.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN, that the Town Board of the Town of Lewisboro will hold a public hearing on May 19, 2008 at 8:00 p.m. at the South Salem Library, 15 Main Street, South Salem, New York for the purpose of hearing the public with regard to proposed adoption of a Local Law amending Chapter 220 (Zoning Ordinance) of the Code of the Town of Lewisboro as it pertains to the regulation of Communication Facilities and Communication Towers.

It is proposed to amend Section 220-41.1 (C) of the Code as follows:
(2) The siting of a communication facility on property owned by the Town of Lewisboro may be allowed, and additional conditions may be required by the Town and thereafter incorporated into any approval given under Section 220-41.1
It is proposed to amend Section 220-41.1 (E) as follows:
(1)Any proposal for a communication tower, antenna tower or monopole shall prove that the height is the minimum necessary for adequate reception and transmission to meet the applicant’s service coverage needs and does not exceed 80 120 feet.
It is proposed to amend Section 220-41.1 (E) as follows:
(4)Setbacks. All communications towers, antenna towers or monopoles shall be set back and separated from all property boundary lines of the lot on which it is located by a distance equal to twice the height of the tower plus 10 feet. (Remainder of paragraph unchanged.)
